1. 1. Information Obtained by Your Submission

Victory Elixir obtains/may obtain certain personal information through your usage of this Site.  Such personal information may include:

1. 3. Information Obtained from and by Third Parties

Victory Elixir may engage the services/technologies of other third parties in the course of Victory Elixir’s business and running the Site.  In doing so, it is possible that Victory Elixir may receive customer information from them, or they may receive Victory Elixir customer information. 

Such third parties may include: social media sites and apps, Victory Elixir’s business partners (advertising partners, analytics vendors, and retailers and other distributors), and companies that otherwise provide consumer insight services.

Victory Elixir uses third-party web analytics services, including Google Analytics and Facebook Pixel.  Google Analytics, Facebook Pixel, and other third-party services Victory Elixir may utilize automated technologies to collect data (such as IP addresses) to evaluate and monitor Site usage.  

Finally, Victory Elixir, also uses certain third-party payment processors (including Stripe and Paypal) to process your payment.  These third parties may have their own privacy policies and data collection standards that you should familiarize yourself with.

1. 4. How Victory Elixir Uses the Information Obtained

Victory Elixir will process your personal information lawfully, fairly and in a transparent manner. 

Victory Elixir will collect and process information about you only where there are legal bases for doing so.  These legal bases depend on the services you use and how you use them, meaning your information is collected and used only where:

• Necessary for the performance of a contract to which you are a party or to take steps at your request before entering into such a contract (for example, when providing a service you request from us);
• A legitimate interest is satisfied (which is not overridden by your data protection interests), such as for research and development, to market and promote Victory Elixir’s services, and to protect Victory Elixir’s legal rights and interests;

This Privacy Policy covers the use of cookies between your device and Victory Elixir’s servers. 

A cookie is a small piece of data that an app may store on your device, typically containing a unique identifier that allows the app servers to recognize:

• your device when you use the app; 
• information about your account, session and/or device; 
• additional data that serves the purpose of the cookie, and any self-maintenance information about the cookie itself.

Victory Elixir reserves the right to use cookies to give your device access to core features of the Site, to track app usage and performance on your device, to tailor your experience of our app based on your preferences, and to serve advertising to your device.  Any communication of cookie data between your device and Victory Elixir’s servers occurs within a secure environment.

You may set your web browser to notify you when you receive certain cookies.  You may also restrict or disable certain cookies via your web browser.  For example, on some internet browsers, you may utilize a “do not track” feature that limits what a website can track.  These features vary depending on the browser and the website.  Victory Elixir currently does not respond to those signals.  As such, if you use such features to block cookies, certain features on the Site may not work, and some tracking features may continue.  Victory Elixir is not responsible for any changes in usage resulting from your restriction of certain cookies.

1. 6. Who Victory Elixir Shares Information With

As perhaps noted otherwise in this Privacy Policy, Victory Elixir may share information obtained from Site visitors in the following ways:

• Internally between our employees and our affiliates;
• On the Site, for example, if you post a review or a testimonial;
• With third-party service providers for the purpose of enabling them to provide their services, including (without limitation) IT service providers, data storage, hosting and server providers, ad networks, analytics, error loggers, debt collectors, maintenance or problem-solving providers, marketing or advertising providers, professional advisors and payment systems operators;

The personal information Victory Elixir collects is stored and processed in the United States, or where Victory Elixir or our partners, affiliates and third-party providers maintain facilities.  By providing Victory Elixir with your personal information, you consent to the disclosure to these overseas third parties.

Victory Elixir will ensure that any transfer of personal information from countries in the European Economic Area (EEA) to countries outside the EEA will be protected by appropriate safeguards, for example by using standard data protection clauses approved by the European Commission, or the use of binding corporate rules or other legally accepted means.

Where Victory Elixir transfers personal information from a non-EEA country to another country, you acknowledge that third parties in other jurisdictions may not be subject to similar data protection laws to the ones in our jurisdiction.  There are risks if any such third party engages in any act or practice that would contravene the data privacy laws in our jurisdiction and this might mean that you will not be able to seek redress under our jurisdiction’s privacy laws.

1. 8. How does Victory Elixir Protect Your Data?

Victory Elixir maintains a variety of security measures to protect customer data.  Importantly, Victory Elixir uses an SSL certificate and HTTPS protocol to protect your data.  

Victory Elixir’s payment processors (Stripe, Paypal, and other reputable processors), have their own security measures in order to protect your payment information.

Please note, however, that while Victory Elixir has done what it can to create a secure Site for customers and visitors, the internet is not a secure environment, and Victory Elixir cannot guarantee the confidentiality or security of the data that you transmit to Victory Elixir.  As such, Victory Elixir cannot be responsible or liable for the security of your data that you transmit through the internet.

Victory Elixir does not solicit or knowingly obtain, use, or store information submitted by a minor under the age of 18 without obtaining prior consent from a responsible parent or guardian.  The Site is not directed or designed to be used by minors under the age of 18 or to collect information from minors under the age of 18.  

If you are a parent or legal guardian and believe that your child under 18 has transmitted personal information to Victory Elixir, please write to us on our “Contact Us” form, and expressly label your concern as “Request About Children’s Information.”

From time to time, Victory Elixir may include links to third party sites on the Site.  This Privacy Policy does not address the privacy or information policies of any third parties.  These third-party sites have separate privacy policies, and Victory Elixir expressly disclaims any liability or responsibility for the content and activities of these linked sites.  You alone are responsible for reviewing that third-party sites’ privacy policies and deciding whether to commence any activities on such third-party sites.

This California Privacy Notice applies solely to California customers and viewers of the Site.  The purpose of this California Privacy Notice is to supplement this Privacy Policy for California residents, and to ensure compliance with the California Consumer Privacy Act of 2018 (the “CCPA”) and its implementing regulations.

Victory Elixir does not knowingly or purposefully engage in the sale of California Personal Information as the term is used in everyday parlance.  Any “sale” of such California Personal Information that falls under the CCPA terms “sale” or “sold” happens via exchanging the California Personal Information with media, advertising companies, and other third-party vendors through cookies and online advertising.

Victory Elixir may collect (and may have already collected over the past twelve months), the following personal information (“California Personal Information”), as defined by the CCPA

• Identifiers: name, address, unique identifiers (via cookies, beacons, etc. as described herein), telephone number, email address, IP address, other payment information, signature, online identifiers, other financial information;
• Other information, to the extent transmitted to us through the Site: signature, physical characteristics/description, bank account number, credit/debit card numbers, medical information, health insurance information, state identification card number, audio, electronic and visual information, internet use information, geolocation information, professional/employment-related/education information;
• Characteristics that fall under or imply protected classifications under California and/or federal law;
• Commercial information and internet/other network usage and activity; and
• Inferences drawn from the above categories.

The above categories of California Personal Information may be used by Victory Elixir for purposes described in Section 4 herein.

The above categories of California Personal Information may be collected by Victory Elixir in the ways described in Sections 1, 2, and 3 herein.

1. 13. Rights of California Residents under CCPA 

California residents have the following rights with respect to their California Personal Information, pursuant to the CCPA:

• Notice: you can request that Victory Elixir disclose to you the categories of California Personal Information that has been collected about you, the categories of sources from which the California Personal Information has been collected, the categories of any California Personal Information that has been sold or disclosed for business purposes (under the CCPA), and the specific pieces of California Personal Information that has been collected over the period of the last 12 months.
• Opt-Out: you can request that Victory Elixir does not “sell” California Personal Information to third parties.  To opt out, please: opt-out
• Deletion: you can request that Victory Elixir delete any California Personal Information that has been collected from you.
• Non-discrimination: Victory Elixir may not discriminate against you if you exercise your rights under the CCPA.

To exercise your rights under the CCPA, please: Email to [email protected] and please include the heading “CCPA Request.”  You or an agent authorized by you can make such a request (such agent must have written evidence of your authorization).  If you or your agent make such a request, Victory Elixir may require verification of your identity and/or authorization before complying with your request.  If Victory Elixir is unable to verify the authenticity of a request, we may ask you for more information or deny your request.  To the extent that you submit a request to disclose or alter/delete your California Personal Information, Victory Elixir may charge you a small administrative fee to cover the costs of the request.

Victory Elixir does not knowingly or intentionally “sell” personal information of Nevada residents as defined by the Nevada Privacy Law (the Privacy and Security of Personal Information Chapter of the Nevada Revised Statutes Section 603A).  If you are a Nevada resident, you nevertheless have the right to submit a request – which we have a right to verify – to Victory Elixir, instructing us not to make any sale of certain “personal information” as defined by the Nevada Privacy Law.  You can make such a request through our “Contact Us” form, and we ask that you please indicate that you are a Nevada resident, and entitle the request “Nevada Opt-Out.”  To the extent that you submit a request under this section, Victory Elixir may charge you a small administrative fee to cover the costs of the request.

Under the EU General Data Protection Regulations (“GDPR”), EU citizens and residents have the right to certain information and options with respect to their data, including the following:

• You have a right to request that Victory Elixir correct any information you believe to be inaccurate or incomplete;
• You have the right to request that Victory Elixir erase your personal data, under certain conditions;
• You have the right to request that Victory Elixir restrict the processing of your personal data, under certain conditions;
• You have the right to object to Victory Elixir’s processing of your personal data, under certain conditions;
• You have the right to request that Victory Elixir transfer the data we have collected to another organization, or directly to you, under certain conditions.
